How long do I have to claim?

Generally, in the UK, you must start a personal injury claim within 3 years from the date of the accident. There are, however, a number of exceptions to this general rule. If you believe you have a claim, you should contact us as soon as possible so we can advise you whether any of the exceptions apply to your personal situation.

Who will pay my compensation?

Usually, the insurance company acting for the person responsible for the accident will pay your compensation. For this to happen, liability (legal responsibility) for the accident needs to be determined.

If you instruct us, we would liaise with the responsible driver and his/her car insurance company, to determine and agree on liability. This can take some time as the responsible driver’s insurance company has 21 days to acknowledge the claim, and a further 3 months to admit or deny that their driver was at fault for the accident. This can be even longer if the insurance company needs to wait for a copy of a police report before responding to the claim.

What is the road traffic accident claims process?

Once the issue of liability is resolved, Grieves Solicitors would obtain details of any financial expenses you have incurred. We would also arrange a medical examination with a specialist to obtain a report which will be used to value your claim for the injuries you have sustained.
