Who will pay my compensation?
Usually, the insurance company acting for the person responsible for the accident will pay your compensation.
If you instruct us, Grieves Solicitors would send out a letter to the responsible driver and his/her insurance company setting out the circumstances of the accident, and giving details of your claim. Lawyers refer to this as the 'letter of claim'.
The responsible driver's insurance company has 21 days from the date they received our letter of claim to acknowledge receipt and a further three months to admit or deny that their driver was at fault for the accident.
Sometimes insurance companies will not respond to a letter of claim if the police were involved because they require a copy of the police accident report. A police accident report does not, however, become available until the police investigation has concluded and this may take some time.
Once the issue of liability has been resolved, Grieves Solicitors would then obtain details of any financial expenses you have incurred. Lawyers call these expenses 'special damages'.
Grieves Solicitors would arrange a medical examination with a specialist to obtain a report which will be used to value your claim for the injuries you have sustained. Lawyers call compensation for your injury general damages. Only when this medical report has been approved by you would it be disclosed with the list of your financial expenses to the responsible driver's insurers requesting an offer in settlement of your case.
The process can take several months before it is resolved and delays can occur due to the size of the insurance company concerned or if the accident circumstances are not straight forward. Other delays can occur during the process and so it is very difficult to say how long a car accident claim can take although, at Grieves, our team of specialists will do everything they can to resolve your case as quickly as possible and with the best result for you.
