Do I have a claim?

If you have been injured as a result of a road traffic accident, then you may be entitled to compensation. This includes injuries resulting from:

With road traffic accident claims, it is important to engage a specialist as soon as possible after an accident. This will make it easier to gather information on the accident as it will be fresh in the minds of those involved. Additionally, many motor insurance companies try to settle the injury claim directly, which could result in less compensation awarded to you.

Grieves Solicitors has specialist road traffic accident solicitors who will work hard to make sure you obtain the compensation you deserve.

How long do I have to claim?

Generally, in the UK, you must start a personal injury claim within 3 years from the date of the accident. There are, however, a number of exceptions to this general rule. If you believe you have a claim, you should contact us as soon as possible so we can advise you whether any of the exceptions apply to your personal situation.

What can I claim for?

Every case is different, but generally the more serious your injuries and the greater the impact your injuries have on your daily life, the more compensation you need to cover the financial cost of your accident. Cases usually involve claims for two different types of compensation:

General damages – Compensation for the pain, suffering and loss of amenity you have suffered as a result of your accident related injuries. Essentially this is compensation for the impact of the accident on your physical and psychological health, as well as the impact on your everyday life. The sum to be paid will be decided by the court.

Special damages – Compensation for financial losses related to your accident. Examples include:

  • your loss of earnings
  • travel to medical appointments
  • motor insurance policy excess
  • repair costs
  • car hire charges
  • damaged property (from your vehicle)
  • medical expenses, e.g. prescription fees

While this can seem a bit overwhelming, we have the expertise and experience to support you through the claims process, to make sure you obtain the maximum compensation possible.

Who will pay my compensation?

Usually, the insurance company acting for the person responsible for the accident will pay your compensation. For this to happen, liability (legal responsibility) for the accident needs to be determined.

If you instruct us, we would liaise with the responsible driver and his/her insurance company, to determine and agree liability. This can take some time as the responsible driver’s insurance company has 21 days to acknowledge the claim, and a further 3 months to admit or deny that their driver was at fault. This can be even longer if the insurance company needs to wait for a copy of a police report before responding to the claim.

What happens after liability has been determined?

Once the issue of liability is resolved, Grieves Solicitors would obtain details of any financial expenses you have incurred. We would also arrange a medical examination with a specialist to obtain a report which will be used to value your claim for the injuries you have sustained.

Only when this medical report has been approved by you would it be disclosed with the list of your expenses to the responsible driver's insurers requesting an offer in settlement of your case.

Resolution of a claim can take several months, and delays can occur if the accident circumstances are not straight forward. At Grieves Solicitors, our team of specialists will do everything they can to resolve your case as quickly as possible whilst ensuring the best result for you.
