SNOW AND ICE - CAN I CLAIM IF I AM INJURED?
SNOW AND ICE – Can I be sued for clearing the road where I live? Helen Grieves, Principal of Grieves Solicitors, Personal Injury Specialists, which she established 14 years ago, welcomed the guidance from Direct.gov about the clearing of snow and ice from public roads. She said, “It is regrettable that people are not prepared to help clear public roads or pathways in case they are sued. All we need to do is to apply a bit of common sense.” She said, “If people are worried, they can look on the Direct.gov website which gives guidance on the best way to clear snow and ice, such as not using hot water which can freeze and cause black ice but to spread salt instead.” The council have a duty to clear snow and ice from the pavements and roads in accordance with their winter maintenance policy. If you have an accident because the pavement and/or road has not be cleared in accordance with this policy then you may have a claim against the Council for failure to clear and make the area safe.
