Who will pay my Road Accident compensation claim?
Usually the insurance company acting for the person responsible for the accident will pay your compensation.
If you instruct us, Grieves Solicitors would send out a letter to the responsible driver and his/her insurance company setting out the circumstances of the accident, and giving details of your claim for compensation. Lawyers refer to this as the letter of claim.
The responsible driver's insurance company has 21 days from the date they received our letter of claim to acknowledge receipt and a further three months to admit or deny that their driver was at fault for the accident.
Sometimes insurance companies will not respond to a letter of claim if the police were involved because they require a copy of the police accident report. A police accident report does not, however, become available until the police investigation has concluded and this may take some time.
Once the issue of liability has been resolved, Grieves Solicitors would then obtain details of any financial expenses you have incurred. Lawyers call these expenses 'special damages'.
