Claiming Compensation for Injuries Caused by Animals
The Animals Act 1971 recognised the need for a law placing the blame for the actions of animals at the feet of the owner, whilst at the same time allowing for financial compensation to be paid for damage and injuries caused by animals.
Owners of animals such as cattle, dogs or horses are duty-bound to ensure the safety of other members of the public when interacting with their animals, for example:
- owners of cattle must ensure that vehicle users on or near their land are adequately protected from cattle straying on to the road or other public right of way;
- owners of dogs must take adequate steps to ensure their dog does not cause injury. For example, if a dog has a history of violence and aggression and the owner fails to ensure the public are protected, they may be held liable for any subsequent injuries involving that animal.
In short, if it can be demonstrated that the owner of an animal was in some way negligent, and that this negligence led to an accident involving an animal, you may be eligible to make a claim for financial compensation.
